Terms of Service

These terms exist to protect you, protect our community, and protect the meaning of this space. They are not designed to trap you or intimidate you.

Nimbus Novem is authored, not neutral infrastructure. It has values, boundaries, and intentions. Participation implies respect for these.

• You must be at least 16 years old to use Nimbus Novem. Certain features — including selling through the Vault or MyStore, accessing adult content, and participating in age-gated events — require you to be at least 18 years old. Individual events may be marked 18+ or 21+ where applicable.
• Accounts are personal. No impersonation of others.
• We may refuse or revoke access if necessary to protect the system or its participants.

When you enter Nimbus Novem, this is what we agree to:

You bring:

• Your presence
• Your dignity
• Your willingness to respect others
• Your understanding that silence is valid

Nimbus brings:

• A space that protects your presence without demanding performance
• Systems that do not exploit your attention
• Ownership of your work and your data
• Quiet governance that serves the community

By checking the consent box during signup and creating an account, you affirmatively agree to these Terms and acknowledge our Privacy Policy. This constitutes your electronic acceptance and legally binding consent. If you do not agree, do not create an account.

We record the version of these Terms and the Privacy Policy you agreed to at signup. If we make material changes, we will notify you and may ask you to re-consent before the changes take effect.

These are structural commitments, not marketing promises. If we ever break them, you have every right to leave and to tell others why.

• We will not rank people by followers, likes, or popularity
• We will not create urgency to manipulate behavior
• We will not sell your attention to advertisers
• We will not punish inactivity
• We will not expose private signals publicly
• We will not gamify your participation

You may:

• Create and share content you own or are authorized to share
• Participate respectfully in member spaces
• Sell your own work through approved systems (Vault / MyStore)
• Observe without posting — silence is valid participation

You may not:

• Harass, threaten, or coerce other members
• Spam, scrape, or automatically harvest data
• Game systems for visibility or manipulation
• Attempt to reverse engineer private systems or bypass safeguards
• Share others' private content without consent

If you create content or artifacts within Nimbus Novem:

• You own your work. We do not claim ownership of what you create.
• You control visibility. You decide what is public, what is shared with members, and what stays private.
• You control archiving. Your content enters the Archive only with your consent.
• You can leave with your work. Export at any time, in standard formats, without penalty.

We may display your public content within Nimbus Novem to other members. We will never sell it, license it without permission, or use it for advertising outside this space.

By sharing content publicly within Nimbus Novem, you grant Nimbus Novem a limited, non-exclusive license to display, reproduce, and distribute that content within the platform for the purpose of operating and presenting the service to other members. This license ends when you remove the content or delete your account. We do not use your content to train external AI models, and we do not sell or license your content to third parties.

If you sell through Nimbus Novem:

• You set your own prices. We do not interfere with your pricing decisions.
• You handle your own fulfillment unless otherwise arranged.
• You are responsible for the quality and legality of what you sell.
• We take a small platform fee to sustain the space. This is disclosed before you list.

We do not boost listings based on performance. There is no “best seller” badge. No urgency language. Your store reflects your work, not algorithmic favor.

Products sold directly by Nimbus Novem are fulfilled by Nimbus Novem as outlined in our Shipping Policy. Separate from Nimbus Novem's direct product offerings, the platform may include creator-driven spaces — such as the Vault and MyStore — where independent users sell their own products. Those sellers are responsible for their own fulfillment and product quality unless otherwise stated on the listing.

Nimbus Novem acts as a platform for seller transactions but is not a party to transactions between independent sellers and buyers. Payment processing is handled by third-party processors (including Stripe). Sellers are responsible for their own tax obligations and customer service. Nimbus Novem may mediate disputes but is not liable for seller performance or buyer dissatisfaction with marketplace purchases.

Nimbus Novem sells physical products — apparel and related accessories — directly through this website. When you buy something from us, the transaction is straightforward:

• Each purchase is a standalone transaction for the product itself.
• Payment is for the product. It is not a payment for access, membership, or community participation.
• Orders are subject to product availability. Limited releases may sell out.
• Fulfillment, delivery windows, and tracking are described in our Shipping Policy.
• Returns and refunds follow our Refund Policy.
• Payments are processed securely through our payment provider. We do not store full card numbers on our servers.
• Payment processing is provided by Stripe. Your card data is handled by Stripe under their PCI-compliant infrastructure. Nimbus Novem does not store or transmit full card numbers.

Buying a product does not obligate you to participate in any community feature, and choosing not to buy does not diminish your standing here.

Community access at Nimbus Novem is shaped by participation, and is separate from any product purchase:

• Participation may include access to community features. These features are offered as part of the experience and are not sold as a paid membership.
• Continued access is supported by minimal annual activity — for example, one message, one contribution, or simply checking in within 12 months. Buying a product is one of several ways to stay active, not a fee for access.
• You receive reminders before access changes — no surprises.
• If access pauses, your data remains. You can always export it.

Products do not require participation, and participation does not require a purchase. Expiration is not punishment. It is a boundary that protects the integrity of the space.

Nimbus Novem was founded and is stewarded by Shannon Winfield. The Founder retains authority to:

• Protect the meaning and integrity of the space
• Make quiet adjustments to atmosphere and pacing
• Pause systems that drift from the core values
• Interpret ambiguous situations in favor of community dignity

You may leave Nimbus Novem at any time, for any reason, without explanation. When you leave:

• You can export all your data first
• We will delete your account upon request
• We will not guilt you into staying

We may end your access only if you seriously violate community standards or engage in harmful behavior. This is done:

• Privately
• With explanation
• With opportunity to export your data

We may also temporarily suspend access — without permanent termination — when investigating potential violations. Suspension is not punishment. It is a precaution that protects the community while we determine what happened. Suspended users retain the right to export their data and to appeal the decision.

Nimbus Novem operates within applicable laws. We:

• Comply with valid legal requests when required
• Protect user data to the extent permitted by law
• Do not create legal pressure to enforce minor policies

We are not your adversary. Legal language exists to protect both of us, not to trap you.

Nimbus Novem respects intellectual property rights. If you believe content on this platform infringes your copyright, you may request its removal by contacting us at contact@nimbusnovem.cloud with the subject line “Takedown Request.”

Include the URL of the infringing content, proof of ownership, and a statement made under penalty of perjury that the claim is accurate. We will review and act on valid requests promptly, in accordance with applicable law.

Nimbus Novem is a living space. It may evolve:

• Features may change, pause, or be retired
• We aim for continuity but do not guarantee uninterrupted service
• Changes that affect your rights will be communicated in advance

If we change these terms:

• We will notify you in advance
• We will explain what changed and why
• Changes will not retroactively reduce your rights
• You can leave before changes take effect if you disagree
• For material changes, we will ask you to re-consent before they take effect. Continued use after the effective date constitutes acceptance of non-material changes.

Nimbus Novem is provided “as-is.” We do our best to maintain a meaningful, functional space, but we cannot guarantee perfection.

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of Nimbus Novem.

This is not adversarial. It is honest about the limits of what any system can promise.

Nimbus Novem is a platform, not a party to transactions between users. We are not liable for the actions, content, or products of independent sellers, or for interactions between members. Our role is to provide and maintain the space.

You agree to indemnify and hold harmless Nimbus Novem and its operators from claims, damages, and expenses arising from your content, your conduct, or your violation of these Terms. This includes claims from third parties related to content you upload or transactions you conduct on the platform.

These Terms and any dispute arising out of or relating to these Terms, the Platform, or the services provided by Nimbus Novem shall be governed by the laws of the State of Illinois, without regard to conflict-of-law principles.

Before initiating formal proceedings, the parties agree to attempt in good faith to resolve the dispute informally for at least 30 days. If the dispute cannot be resolved, any arbitration shall take place in Illinois, unless applicable law requires otherwise. Any court proceeding permitted under these Terms shall be brought in a court of competent jurisdiction located in Illinois, except that an individual may bring an eligible claim in small-claims court where permitted by applicable law.
